OK, I have a problem with Sherman Acq-whoever they really are.
Several years ago (1990s) I filed Chapter 7 bankruptcy and had a debt for $459 to Providian discharged.
In August 2000, I filed Ch. 13 and am making payments to the trustee bi-weekly from my paycheck through Aug. 2005.
Any debts incurred after Aug. 2000 - until the Ch. 13 Bankruptcy is discharged - would have to be approved by the trustee. I have not had any new debts since late 1999 and have not asked the trustee to allow me to enter into debt.
On my credit report a new debt has popped up - stating acct. opened 10/2002 through Sherman Acq for more than $1,000 and it has the same acct. # as the old Providian acct. They have contacted the trustee wanting payment and I explained that this apparently was a several year old debt discharged in previous bankruptcy.
TransUnion report says:
Sherman Acq
Acct#
Open acct
Updated: 01/2003
opened 10/2002
balance: $1043
most owed: $985
status: collection acct
Factoring company account
Individual account
12 Metris Companies Inc.
As of 01/2003: <collection account>
Sherman Acq has folks calling me and wanting payment. I have contacted TransUnion to have the debt removed sending copies of old reports and bankruptcy documents but Sherman won't budge. Sherman said they acquired the debt in 2002 as a collection acct and refuses to acknowledge the proof I have shown.
My bankruptcy attorney doesn't really suggest anything, but agreed they are trying to get money from a discharged acct and I shouldn't pay a debt that I no longer owe. He also said that they had no right to re-age the acct.
Any suggestions? :(
