View Full Version : Harassment, Settlement, payment, validation requested, now t

I have been harassed by NCO Financial Systems. They threatened to sue me, call me at work every day ("this is Amrica buddy"), and have a wage attachmet on my salary as well. They offered me to settle because otherwise i would have no choice and they would seize 30% of my salary. The settlemet terms we negotiated on the telephone were pretty advantegwous for me 30% of total. They asked me for my bank information and rounting numebr and a check number. When i argued that i was unconfortable doing so they aregued back that by no means that information would be used in anay other way that to collect one check. After posting here in this discussion board immediately following that, i was advised to send a request for validation. I did just that and mailed NCO your sample letter. I called back the next day to let them know know that I was requesting them to stop the payment until they had responded to the letter that i was mailing to them. I called 7-8 times the local number I had and always got to a voice mail - i finally decided to leave a message specifiying that I was mailing to them a letter requestin validation and that I was asking them to suspend/cancel the payment. I would consider making the payment after validating the debt and receiving confirmation that is was going o be paid in full. I ene called the office in PA on the 1-000 number and was re-routed to a different office and would not be transferred to the PA office were my account was being handled. I called back again on tuesday morning to ask them if they had recived my message and letter - they said that the check was going to be collected and was posted in anyway but that they had sent me a letter. I aked them if they did not get my message and they said "no" - so I asked them howcome they were sending me aletter if they never heard my message... Anhow - they did not want to stop the collection of the check because it was too late. I requested a stop payment by my banck and so far the check has not been cashed. What are my options, any suggestions on what may happen and what i should do next?

I think you are doing the right thing by sending them the letter and stopping payment on the check. Never give out your checking account information.

I'd wait for their response on the letter and just follow the procedure right on down the line. And don't talk to them on the phone again. ;)

Also all thought you stopped payment on that check make sure to tell you bank not to accept anything from them..
About 5 years ago my husband a nd i stopped a payment on a checkthat we had with them about 10 days later my bank called me and told me that Nco attempted
to process another check tis check had my routing number account number and a made up check number the reason they were caught was becasue the check number that they made up was a number that i had alrready used and the system kicked it out....

Change your account numbers now if you can. Tell the bank that these people have a reputation for doing bad business and they are violating federal laws.

Maybe this will help you in at least keeping them out of your bank account

By changing account numbers I mean closing that account and opening a new one. DUH..brain is moving faster than my hands

Unfortunateley the stop payment that I asked my bank to take care of did not work and they were able to get the amount despoite the fact that my checking balance was below the amount... the banck posted the transaction as they mentioned that I had funds in my saving account...since I had asked NCO that I was no longer intending to pay until they validated the debt... and sent them the letter of validation. I have called my bank and shared with them the issue and they saud they would try to get the money back... What next, what can I and should I do.

My next advice would be to have the bank say they went in after the fundsd illegally. You told them you didnt want to pay and they took the money anyway. Its an unauthorized transaction as you tried to rescind it. Try that route with your bank. If they can transfer the money to an account, they can get it back. Dont let them tell you they cant do it.

I should have changed my account number. Unfortunately I thought that the stop payment would have worked... I appreciate your advice, thanks!

Within the first few days, the bank CAN reverse the transaction. I have successfully had them do this.

I would point out that you had paid for the stop payment and they made the error and it was their responsibility to fix it.

My 2 cents...

You made a mistake calling these jacka$$es at NCO to request they not use the check and telling them you were sending validation. You tipped your hand and they acted to collect with the bank info you gave them.

First rule, NEVER, NEVER do ANYTHING over the phone with these CA scum, they lie, cheat and STEAL. Just don't talk to them, do EVERYTHING in writing only and use certified mail every time so that you have a traceable paper trail for your records.

I'm sorry you lost the money and I hope the bank will work with you, but you really need to close that account ASAP. If you think they won't try to draft ANOTHER check using the SAME information and WITHOUT notifying you they are going to do it, then you are kidding yourself. As long as they have your bank info to draft your account, they will re-use what you gave them and rob you blind !!

Thanks for the reply and the information I will do as you advise. I am very lucky and fortunate: My bank was able to get the money back. Now they have not sent any validation yet, and it's been more than 6 weeks. What should I do? Just wait?

I have closed my account and I have sent letter two. Still waiting for information. Meanwhile they have called me and left a message that they are going forward with a judgement in Texas. I live in NM.

A judgment in Texas is pointless unless they then have it domesticated to NM for enforcement, and some states won't enforce 'foreign' judgments.

Why are they suing you in TX ? Did you live there when the account was opened ?
