An interesting decision issued by a Penn Fed Court today. Sears allegedly mismerged two files and the CRA's reported that the plaintiff was deceased. Didn't this happen to someone here once? Jeffbeish perhaps? Anyway, Swede will post a link to the discussion before the night is over:

LOL actually we've had 2 cases of deceased people haunting the board here, Kimber and quickpic. Thank god they've been resurrected

Sears may think I'm dead meat but when they get the summons it will be a surprise. No, my case was about a Sears card I opened in 1973 and that it had not used for at least ten years now. When I called their legal department some nice young lady promised and subsequently sent me only 7 years of billing statements on that account. No charges are on them, only the usual late fees, interest, and everything else they can think of.
Why I am suing them is to recover records back beyond 7 years to see how my account was used and how the balance got from zero to nearly $1,500. No one in my family used it. I stopped entering into Sears in October 1992 after they failed to deliver a refrigerator when mine went south (hurricane Andrew did it). Then they nearly killed my daughter by ripping off three of the five lug bolts on a wheel (she bought tires there) and blamed her for it!
So, I settled for 50% and promised to sue them for the records, and if I found anything fishy in them I was off to superior court. I can understand why they would send me only 7 years of records. Probably could claim they had no proof of the charges with only 7 years of statements, but they caught me in a weak state of mind.
