View Full Version : HHS after 10 years, now DOJ??!!

Long story short-

I borrowed 4K from Hinson-Hazlewood(HH) in 1992 school year. I borrowed 4K from HH in 93 school year.

I quit grad school and exited society.

I rejoined society in 1995, and called HH (and 15 other lenders) asking about loan status/repayment. HH said I had 2 loans, one was paid and one outstanding. I repaid outstanding HH(and 15 others) over next six years.

In 2000, I got letter at my parents address (haven't been there in 15 years) from Dept of Health and Human Services stating default on 4K loan, now at 8K.

I called HHS, they said they mailed qtly stmts to me. I asked for copies, since I had paid all loans. The stmts in question had been sent to an old phy address and I never received them.

I told them I would not sign note for 8K since I never recd stmts and had been told by HH several years ago that all loans were paid. They said they would send it to DOJ, and I said "please do". I made appt with AG (local) and he said it sounded workable, and that he would contact me when the acct was sent to his office. Three years later (last month) I see inq on CR from 2 skip-tracers. I called them, they said they were looking for address for HHS. I told them it was the same address I had 12 years ago. I called HHS, they said if I wouldn't sign agreement for 9K they would turn it over to DOJ (sound familiar?)

All my loan papers show the same POB on the promissory note. In college I never gave phy addr because of frequent moves/roommates. To this day I still have same POB., and have recd no mail from HHS except the copies I requested.

Now what do I do?? I will gladly go to court and defend myself, and if judge says I must pay 9K then I will have to do it, but I think judge will see idiocy in previous contacts and negotiate something reasonable.

Will HHS simply get judgement without contacting me?

All contacts have been made by me. If it were an OC or CA I would have a clue.

What do you do with bureaucrats who make the rules and write the laws and have no SOL???

I signed promissory note for Hinson-Hazlewood, note was guaranteed by Dept HHS.

Sorry that I have nothing to offer to help you, but you are dead on with your comments about bureaucrats and no SOL.

I recd letter from US DOJ, Atty General. I made appt to see them next week for what they call a "settlement conference"

Their letter states:

"Any settlement must be in the form of a consent judgement entered in federal district court, to be filed simultaneously with the governments complaint in this action"
What does this mean? What is a consent judgement? Should I get a lawyer?
I'm in Texas.

Grich, you should post this question in the is there a lawyer in the house section. I am sure calaw or texas can answer this for you.
