what do you do?

ok, i can now say i've read thru every forum since i got here, i hadnt needed this one before..

but isnt it amazing what you find out when you get your CR?

so, a relative (i am quite aware of who, just finished yelling at em on the phone) has applied for credit, the credit was refused due to having a fraud alert (glad i had that on there)

what do i do??? argh!

What is it you're looking to do? File charges against the person or remove the inquiry?

stop them from doing it again

i cant say on filing charges til we have a family meeting.

Fortunately the fraud alert did its job. Without knowing your family, start by explaining the ramifications for committing such an act. As the laws regarding ID theft change, the decision to press charges will soon not be a decision for an individual to make – it will be automatic and it will be severe. Much the same as domestic violence laws have changed.

Hopefully that will be enough to knock some sense into the relative.

This is very important that you take care of this, regardless of a family meeting. This is your credit this other person is trying to fraudulantly use! The ramification is that if they open an account, and run it up and not pay - then this reflects against your credit history technically 7 years, plus the creditor will consider you responsible for the debt. If they break the law, there is no excuse family or not, you definitely don't want to let this happen knowing and having the ability to stop this.

In addition to the fraud alert, you need to forward a copy of your phone bill (portion which shows your name / address / phone number) request that the CRAs add a victim statement to your credit report. Will say something like: "please call me to verify identity before extending credit, victim of ID Theft".

Also even though they did not get a credit card, you want to follow up by filing a police report and an affidavit to be forwarded to the CRA & the Creditor making them aware of the recent inquiry having not been you applying with them. And that you want this removed since what this other person did affected your credit rating by having even applied regardless of approval or not.

Also on any existing accounts, you need to call your creditors and ask if you don't have it in place now, that they password / pin protect your accounts, and that you do not give them permission to talk to any 3rd partys or yourself without having that password / pin number to confirm identity.

Ask for correspondence from all companies involved so that you can keep a record, in the case that you have to legally do something about this problem later. Remember time for prosecuting cases is 2 years from the time they tried to apply.

sent id theft affidavit to the big 3, included cell phone bill to attempt to get them to place that as the number on the fraud alert. hope that works..

called the company involved and they said they did not need an affidavit, but i placed my info in their internal fraud dept, telling them it will not be me who applies for anything from them (i said that in a nice way) told them exactly who did do it.

i'm reeling from the breach of trust, i have been financially helping this person for months! it bites!

i'm gonna send them a bill for my time and expenses in fixing all this, anyone recommend a good CA to sic on em? :lol:
