What happens if you can't pay (Income is exempt) and you have no prospect of ever working again (Disability)?

Its my understanding that the only way unsecured creditors can "force" you into bankruptcy is if you have significant assets that they believe you could sell to pay them off. I'm not sure if they could start the bankruptcy process, but if they were to get judgements against you, you might want to file BK to protect your assets.

Secured creditors can of course foreclose to recover their collateral.

If your assets are exempt, then you may be judgement proof. Unsecured creditors could sue, and obtain judgements against you, but if you have no way of paying them, the judgements are worthless.

You might want to talk with a BK attorney...most will give a free consultation and help you decide what to do.
