I have read many posts on the subject of Calvary Portfolio and am with the understanding that first they are total skumbags, second reluctant to validate if at all, and third difficult to work with after validation. This probably doesn't set them too far apart from any of the other collectors. My concern is what is their track record of suing after receiving DV as opposed to not DVing. I understand my right to have my debt validated but I am worried about the catch 22. They claim to have purchased an account of mine and I am concerned about pushing them into a possible lawsuit.
Should I consider the pro for DVing as collecting ammunition for any possible legal action. The SOL is up next spring and would just like to ride it out and not I "tease the dog" into doing something I may regret.

Interesting question---one of those fork in the road--all roads may lead to ruin--or salvation, and once you take one fork in the road you never will know what would have happened if you took the other fork.
But first understand that calvary is mostly a junk debt buyer--which mostly means they don't have the documentation to collect in court---unless they can force it into Kangaroo court or you don't show up to contest.
But meanwhile you don't know what they have in their hand--if they have decent documentation for the debt---in court--you lose.---to find out what they have in their hand you DV.
But even then you will get a very foggy picture given their track history. Only when they sue and you contest--an outcome possible with either fork you take---only the the discovery process will grant you a clear picture of how strong their case is. But strong case or weak--you can bet calvary will posture their position as unassailable.
So your question now transforms into how you want to posture your self to them--if you DV you are saying in so many words--me heap smart consumer who understands difference between my posterior and scoop shovel.--which is possible to say nicely--and in an non-offensive manner--giving them no right to get angry and say you really PO'd us.--we will sue because you PO's us.
Or alternately you can pretend you are a typical dumb consumer--leaving them to underestimate you.--and get careless?--and possibly take pity on you?
Its your call there---but I am of the always DV school.

They received my DV letter on 09/06/2006. On 10/04/2006, they mailed out the letter to let me know that my account with them has been closed and deleted rom my credit bureau accounts. The letter was signed by a Kristina Magarine, it is possible if you address your DV directly to her that you might have some success. Take this advice with a grain of salt-I am a brand newbie to this, and it is entirely possible that I lucked up with a blind shot DV. Then again, I sent out 4 DV's on that date, and 3 of them closed up imediately, so maybe I know more than I am letting on. xangelx All the best with your efforts!

for these guys to be removed, i also was afraid of the guys but i went right at them and the were gone. about 3 monts.
