here is my story -- I defaulted with Citi Card. In May I received a complaint from the Court of Common Pleas and the law firm of Lyons, Doughty and Veldhuis, which I responded to saying that I denied some of the allegations.

Yesterday, I received a Notice of Motion for Summary Judgement for August 28th. They also attached an account summary but all it states is the amount due and the amount past due. There is no backup.

first I need to know if I need to get a lawyer. Second, I need to know if I need to show up in court. Third, I need to know if there is a way to fight this.

Also, the credit card is only in my name. I live in a house but it is owned by my husband and my name is not on the deed. He owned the house before we got married. Could they put a lien on the house?

I live in Delaware.

At this point, I'd file a motion for discovery. Ask for EVERYTHING related to this account. Chances are they may not produce documentation. Any affidavits need to be challenged as heresay and irrelevant - unless from the original creditor.

Show up for each and every hearing. Ask for continuances as much as possible.

As far as the house goes, there's no way that a lien can be placed. It's not in your name.
