View Full Version : Removal of BK 13 dismissal from CRAs?

I need to know how to go about trying to get public record items removed. I had started BK Chapter 13 proceeding to stall while closing on sale of house that was being drug on forever. The sale went through and case was started and dismissed in 2007 since no follow through from lender. Is there a way to DV this?

Unfortunately, once you file the public record is created. The fact that it was dismissed does not alter the actual filing of Ch 13. Ch 13's are reported for 7 years. I don't know if there is a way to remove the record from your CR. Maybe someone else here has been successful with that...

I would see if you could get a copy of the dismissal out of the court file and send it to the credit bureaus stating the matter was filed, but dismissed, and you do not show the dismissal, only the filing.

Was there a reason why you did not withdraw? that looks much better then a dismissal does.

A withdrawal is considered a 'voluntary dismissal'. The effect of filing still goes on the credit reports and it is reported as a dismissal.
