This past June I received a letter from a CA and the attorney with the office sent me a letter and did not send it certified. The letter notified me of a Notice of Appearance and a judgment was filed. No court date nor court room was provided. I sent them a certified letter requesting a DV, they responded with a billing statement from 1995. I asked them to remove this judgment as I did not receive proper summons nor have no knowledge of this account and the SOL has well expired. I visited the courthouse and requested information on the judgment and notice of appearance. I was told their was a Judgment filed. I have no knowledge of this account as the SOL well expired.I recently reviewed my three credit reports and could not find any judgment listed though I can be overlooking it as they have a tendency to be hidden. Please guide me.

Get copies of all the documents in the file and get an attorney help you file a motion to vacate the judgment. If you can do it without counsel, read up on your rules of civil procedure and file the motion yourself.

Keep in mind that you only have a certain amount of time to do so. Sooner is better than later.

I have a few more questions. Should I file a motion against the Collection Agency and the Attorney? Is there anything I should do about GMAC, since they are saying GMAC was the original creditor?
