View Full Version : GCFS Default Judgement - Where to start?

DH was sued by GCFS in 2008 for $2,000. He did nothing about it and they won a default judgement.

They were able to garnish his wages for 2-3 pay cycles, but he left the job shortly after. They tried levying his bank account but they only took about $75 out.

I DV'd them after the notice of the default judgement (duh I now know). He finally has a job and I want to resolve it so its not hanging over our heads.

It very well could be a legit debt, but I really don't know as I cant find any paperwork... and GCFS won't send me any.

Any suggestions as where to start?

If the judgment creditor was able to get a writ of garnishment and a bank levy, there had to be a valid underlying judgment. Whether the underlying debt itself is/was valid or not is of no consequence at this point.

If you want to make payment arrangements, contact the attorney of record and give him a hard luck story and offer $25/mo. They've already tried and mostly failed to execute the judgment, and since it costs between $45 to $100 buck to file a writ or a levy, they'll probably jump at the chance to get some money without having to invest more themselves.

If they won't accept payment on your terms, you'll just need to conduct your financial affairs in a manner which prevents them from locating your assets. Approach this with the mindset that you are in charge.
