I rec'd a summons in the mail for medical bill and at the time was not working nor did I have any income my husband only 1 working. I explained to the collector that I could not pay the bill for such reasons and could not show up at court because I was ill at the time. Me not knowing what was going to happen because I have never had anything like this before thought that they would not take me to court and work with me on payment arrangements. well that just did not happen they went to court without me being able to attend and was awarded favor. I was in chapter 13 also which made it hard for me. My lawyer did not include this bill because it was obtained after filing. I want to know how do i get this removed from my credit report because now it on there. This bill was obtained in 2005 and attempted to pay on it when I could and now they are sending me threatening letters. I am now on disability and cannot work what should I do? Any advice would be good.

Nothing... you are on disability, any money from disability cannot be garnished from your bank account, and if it is, you sue them for tens of millions...

You might look into getting it tossed in the BK13, since you would have been under the automatic stay (and if your case is still open)- it's a long shot but worth looking into.

As far as your credit report, it will stay on there for the 7 years. After that it will fall off unless VA allows for a renewal of judgment, in which case, it'll be on there for 7 more.

Fortunately you seem to be judgment proof, they are not going to levy disability money.

Unfortunately, it is not going to come off your credit report. To get a judgment vacated, to start you have to show that you were not served properly - that is not the case here.

You can't have it added to the BK since BK does not protect bills that are incurred after the date of filing.

Are you on permanent or temporary disability? If you ever do go back to work they can garnish your wages.
