Open account: 3 years from the last payment or last charge for goods or services rendered on the account.<br />

Written contracts (non-UCC): 5 years.<br />

Sale of goods under the UCC: 4 years.<br />

Virginia Judgments: 10 years, and renewable (extended) to 20 years.<br />

I called the small claims court in New York to inquire about filing a suit against Sallie Mae, Experian and Pinnacle (3 separate suits). The clerk at the court said the defendant has to be in the same state of filing that I could file there (in there state) but would have to do it in person.  A friend of mine who is not a lawyer said “ if suing for a violation of a federal act, I should be filing in federal civil court“. <br />
<br />
The violations are copied from this site and the situations are listed below; <br />
<br />
Sallie Mae<br />
<br />
Violation: Creditors, if you dispute a debt, and they fail to report it as disputed to the credit bureaus Protection under the FCRA Section 623 a fine of $1,000.<br />
<br />
Situation: I sent a 623 letter on August 25 2010 received 8/27 by Sallie Mae, not marked disputed as of today 9/5 <br />

Experian <br />
<br />
Violation: Credit bureaus if they fail to respond to your written disputes within 30 days (a 15 day extension may be granted if they receive information from the creditor within the first 30 days) Consumer protection afforded by the FCRA Section 611 Part (A)(1) fine of $1,000.<br />
<br />
Situation: Disputed the item on May 24 2010 received 5/27 by Experian, sent follow up letter June 30 2010 received 7/7 by Experian, was updated / verified July 26 2010.<br />
<br />
Note: From the time I disputed until the results of investigation is approximately 60 + days. <br />
<br />
Pinnacle credit services<br />
<br />
Violation: Sections 616 and 617 of the FCRA talk about how much the fines are for violations of the FCRA (the willful and negligent non compliance), typically $1000.<br />
<br />
Situation: I sent a 623 letter on May 20 2010 received on 5/24 by Pinnacle, sent follow up June 30 2010 received 7/6 by Pinnacle,  deleted item but never responded to dispute within 30 day time limit.<br />
<br />
Note:  Willful neglect for not responding within allotted time frame.<br />
<br />
<br />
How do you actually go about filing a suit against a violator of the fcra ?<br />
What court to file in (Federal or …) ? <br />
<br />
Any help or advise would be appreciated to help me sue the above company‘s! I want to put them over a barrel and spank as hard and long as I can.. To open the door for the next person, so maybe just one other person’s life / experience will be easier than mine…</div>

I am new to this site and i wanted to know if anyone could help me. I have written two goodwill letters, one to citibank and the other to capital one, for my credit cards. I am trying to remove the late paymets that are reported on my 3 credit reports. I sent them both out and I only received a response from citibank who did not answer my question with a yes or a no. All they did was report my current balance and told me that &quot;Each month we senf information concernng your account to the credit reporting agencies.....&quot; Has anyone had any success with Citibank and/or Capital One? Do you have any executive names and emails that I can use? PLEASE! any advice would help and be greatly appreciated.<br />

I was paying this account fine until I was laid off from work in March of 2007.  I was 30 days late in May of 2007, and from then on I didnt pay the note.  The car was eventually charged off in September of 2007, but the car was not reposessed until January of 2009. I called numerous times regarding the loan and I was once told the account was sent to their in-house collection agency and it had been sold, and then another time I was told it was actually assigned to the in-house collection agency.  Which is even more confusing because how can you sell or assign something to your in-house collections dept.    It was never marked on my credit bureas as reposessed.  I never recieved a letter of defiency for the remaining balance after the car was auctioned.  So I'm not actually even sure what it is that I owe on the car.  I recently disputed the account for the balances being incorrect because the original amount of the loan was the amount they claimed was charged off.  Well when they updated they updated it as a paid charge off and took the balance down to $0.  Whats most confusing is I havent paid them one red cent, but they show the date of last payment as July of 2009.  I really dont know how to handle this and I have no clue on whether to let sleeping dogs lie, and just take it as a blessing that it has been updated to paid chargeoff instead of a repo, or if I should send them a request for validation considering that they are blatantly lying about recieving any type of payment from me.  Any help on this would be greatly appreciated. <br />

If an OC sold off the debt to another company do they still have the right to report a TL? I was under the assumption that the new creditor should be reporting this and not the OC. <br />
To take it another step further what happens if the OC went out of business and this resulted in a new company taking over the debt. Wouldn't the new company have to add a TL with their info or could they just keep updating the original TL. <br />
I guess what I am asking is, is it legal for a company to update or report on a TL if they don't own the debt.<br />
<br />
Example Company ABC owns a debt and then goes out of business. Company XYZ buys the debt and then keeps reporting on Company's ABC TL on your report. Shouldn't the TL that shows ABC be removed and replaced with a TL from XYZ?</div>

I know for a fact, with no paper proof, that this TL was openend in 03/04, with a DOFD thereafter.<br />
<br />
I disputed this with both CRA's, telling them that the dates were inaccurate and didn't show my DOFD. I will wait to see what they say....<br />
<br />
Two years to fall off for something that should be off within 6 months is rediculous!!<br />
<br />
Was it the right move??</div>

They sent me a detailed bill but with my wife as receiving services. in this detailed statement it had everything that the hospital had done. I call the hospital and they would transfer me to the CA. So I spoke to the manager of the CA. I asked how did they get this medical info. They said they sent me what I requested. I said you and the hospital just violated HIPPA. The CA back paddled and said I am sending a deletion to the CRA. WOW all in a days work.</div>

I've finally taken the first steps in repairing my credit once and for all. In doing so, I sent 3 FOAD letters for 3 old Collections, sent disputes to the 3 Credit Bureaus for the same accounts, and also sent validation letters to the 3 CB for two old credit cards - which link to 2 of the 3 Collections.<br />
<br />
I'm just now starting to hear back from the CBs and my goal was to 623 the OCs. However, one of them - Chase - sent me directly two letters regarding my account. Each letter was the same - one with a copy of my original application and one with a check - in response to my inquiry and said if I want to further dispute the account, to sign their fraud affidavit and they'll contact me. It also said if it's my account to sign their liability affidavit. Obviously I'm hesitant to do either.<br />
<br />
At this point, is Chase's tradeline a lost cause or is there a way to PFD with a charged off account? The account is well over the SoL for suing, but still about 2 years away from getting off my reports - which is my ultimate goal.</div>

My Verizon  debt shows it dropping off one CRA 3/ 2011, another shows it dropping off 7/2011 and the third shows it dropping off 10/2011.<br />
<br />
I was going to wait until the  first one drops off in March 2011 and then send a dispute to the other two CRAs saying CRA #1 has dropped this so you must been reporting  a re-aged account  for July &amp; Oct.<br />
<br />
Does this sound like a good plan?  I'm afraid the July  drop off date might be updated or corrected to the later OCt date.<br />
<br />
I would really like to dispute the timeline with all the CRAs but  am afraid I might lose the early March  drop off on the one CRA if I do .  If it wasn'r so close to the 7 year  drop off date I would dispute the timeline  differences.<br />
<br />
Should I leave these all  alone or as I said, wait until the 3/2011 drops off and then see if the other CRAs will follow after I send them a dispute letter ?</div>

I believe it's because they put in the office address rather than my home address.  nice of them to do that so I wouldn't get the notice).  However, the judgement filed by the law firm (debt collector) is different from the TL I have of the same debt.<br />
<br />
My question is how I should approach this and who I should pay.  I was thinking of negotiating with the creditor that filed the TL and make sure to include that this payment would remove the TL as well as the judgement that was filed by the other law firm.  I wanted to ask to make sure though.  Thanks in advance.</div>

Today I started my NYC apartment hunt, but I have about 6 negative trade lines on my CR and 1 paid judgment.  I explained to the broker I met with in FULL DETAIL about my situation and she was cool and even owned the building I was looking at.  We went back to the office and they pulled up my credit and she then looked at me funny and said I needed a guarantor (the guarantor needs to make 85x the rent and the rent was 1,900 - so kind of not possible):-(.  The thing is - I totally get the apprehension, they just want to avoid a messy situation and on paper, I look like a risk.  BUT all of my stuff is 5+ years old, but not old enough to fall off (NY SOL is 7 years), but she mentioned some stuff from 2008 on my CR, which I think, after looking at my CR was a 30 day late on my student loan, which hasn't been late since and I fully meet the income requirements, etc.. <br />
<br />
Anyway, I feel so exposed.  And maybe I am being crazy, but I just thought I would share.<br />
<br />
My next move is - is to fight to get these negatives off.  Most of them are paid and there are some duplicates where the OC and the CA are both reporting.  Can I send some sort of goodwill letter to these folks?  Explain my situation?<br />

			<content:encoded><![CDATA[<div>I was 30 days late on my July 2010 car payment. This was an honest mistake and my payment history shows I have always been paying what I owe. It has been paid as soon as a Ford Credit agent called. <br />
This debt shows on my credit report. Today I called Ford Credit but nobody was able to tell me that they could remove this debt from my credit report. What can I do to get it removed? Someone at Ford Credit posted on the report. Someone HAS TO be able to remove it!!! <br />
This is terrible news since I am in the middle of escrow on my first house, and my broker told me today that I wouldn't get a loan if the debt account is not removed from the credit report. <br />
All I need right now is a letter from Ford Credit stating that the debt has been paid and that the credit report will be updated. <br />
IS THIS REALLY HAPPENING TO ME?<br />
