Hello Everyone.
I started this new thread here, it actually goes hand in hand with my previous thread (10.7.09 Equifax MOV) Ok so today I called EQ to once again obtain the MOV for accounts I have disputed, I BELIEVE THEY BROKE THE LAW, please read the conversation. (This conversation was recorded with the EQ Representives Permission per PA wire Tapping Law) THE END OF THE CONVERSATION IS THE NOOSE THAT HANGED THEM!! I will skip the formalities of me asking her permission to tape record the conversatio. Ok her it goes, Can anyone point out the violations.... 10/12/2009 1:20pm Me: I am calling regarding the MOV for the 4 accounts that Equifax has verified as being accurate, my Dispute Confirmation # is.... EQ Rep Paton: I do have the answer to the question you had for us, regarding additional information from us, um ok they identify that this is a medical account, that matches your name, social security, and address. Me: Ok I know that, I disputed the amount that I do not owe anything on it. When you verified this account did you guys contact ARB either by phone or was it done electronically does it show? EQ: Electronically Me: Ok by the Electronica verification isn't it true that it just includes my name and social security #, and that is it? EQ: That is the report that um they state here um that um ah you claim the account is not yours, but they verified to Equifax that it does belong to you, because it has the same last name, same first name, same middle initial, social security number and address. Those things um, um those information are the only things that I can see here in our system Mr.... Me: Ok so basically what you are saying happened is, Equifax just used an electronic method of verification without taking in the additonal information which I sent to Equifax on 9/24/09 from the OC stating that is was to be paid by a charity grant. I gave Equifax the name and telephone # of the person to speak to at the OC, But would I be correct in saying that Equifax did not investigate the dispute that way? EQ: The one whom investigates is the Company as well Mr... Me: Ok under the FCRA you are required to consider all relevant information, it sounds like all relevant information was not considered, that you just matched names and social security #,but that is not a proper method of verification or resolution to the dispute. EQ: Um your concern is with the company and they are the ones who are investigating this. That is why I asked you if you already called the company. ***UM HELLO YEA I DID, CMRRR infact on all 4 disputed accounts***<-I did not say this only thought it. Me: The company has been contacted, however it is on my credit file, the CRA's I beleive are obligated to do a proper and through investigation not just verify it by a persons name and social security number. You are required to consider and take in all information the information that I passed on to EQ on 9/24/09, it sounds to me that Equifax did not do that, would I be correct that you did not take anyfurther information except names and ss #? EQ: If you want I can go ahead and dispute this again for you, and I will get all the information from you. Me: Equifax already has that information again I sent that to you on 9/24/09. EQ: Yes Sir. Me: It certainly sounds like EQ did not do a proper dispute/investigation as is required by the FCRA correct? or don't you know? EQ: I DO NOT KNOW THAT Me: So you don't know that, um ok. EQ: Oh I do know that Mr... Me: Ok then lets move to the other disputed accounts STCC and Wells Fargo. Again was that done by Electronic Verification as well? Because I sent them a Certified Letter and they never responded to me so they could not properly verify the account with me, but Equifax has verification that is mine and I would like to know how you verified those accounts as being correct? EQ: WE ARE NOT THE ONES WHO VERIFIED THEM, WE JUST RECEIVE THE INFORMATION FROM THE COMPANY SIR. Me: Ok, so you just said that you did not verify it, you are required to verify it, so you just stated that you did not verify the accts with STCC and Wells Fargo. EQ: IMMEDIATELY HUNG UP!!!! Ok so this what I have, 2 recordings from Equifax basically feeding me a line of Bull, but their documents saying that they verified the accounts as being accurate. BUT!!! THe EQ Rep today stated (again on tape) that they did not verify the accounts..Um Lawsuit? I know that it is $1,000 per violation but man it seems like I could goafter them for more just for their plain ignorance. Ok so I put this out to all of you, what are your thoughts on this, any input advice? Should I go to Small Claims or City/District Court. How do I write the proper letter for a law suit. I mean I think I am going to skip the ITS letter I definately have them by the tail this time. Thanks, I will check the thread tonight for all the advice. Oh um when I called EQ I always get a rep in India, is that their customer service place now? Thanks |

I hope someone here can post some helpful advice. I just want to tell you that I can never get a US CSR on the phone. They have stated to me that it is a crapshoot (their words verbatim) and that you could either get India or their base in GA. Id rather shove bamboo sticks in my eardrums than speak to their reps in India.

LOL that is so true. I have retained an Attorney to go after EQ ($350.00) retainer. Even though I have clear violations on the phone I have to send them a MOV letter CMRRR and wait for their response. They more than likely will not send a response within the 15 days that are required. I will be driving to Harrisburg PA in a few days to fill out the papers and everything. Got my fingers crossed...
